Terms and Conditions of Service

1. Description of the Service
hablo.es (hereinafter, "the Service") is a platform that provides personal artificial intelligence agents accessible through Telegram, a web interface and other communication channels. The Service is provided by WEB3 AND MARKETING CONSULTING LTD (hereinafter, "WEB3").
The personal agent makes it possible, among other functions, to automate tasks, search for information on the internet, analyze documents, manage reminders, run scripts, connect to external services (email, SSH, APIs), generate images using AI, and perform any other task that can be carried out from a command-line environment.
2. Acceptance of the terms
By subscribing to any of the available plans, the user fully accepts these terms and conditions. If you do not agree with any of them, you must not subscribe to the Service.
3. Plans and pricing
The Service is offered on a monthly subscription basis:
- Personal Agent (€9.99/month): your AI agent available 24/7 on Telegram and the web, able to run tasks, connect to external services and automate processes.
In addition, the user must hold an AI balance to cover the cost of the calls to the artificial intelligence models. The balance does not expire and can be topped up at any time.
WEB3 reserves the right to modify prices, giving notice at least 30 days in advance.
4. Payments and billing
Payments are processed through Stripe. The subscription renews automatically each month. The AI balance is charged as a one-time payment at the moment of purchase or top-up.
5. Cancellation and refunds
The user may cancel their subscription at any time from their customer area https://hablo.es/account or by contacting support@hablo.es. The agent will remain active until the end of the billing period already paid for.
6. Nature of the AI agent — Important limitations
The artificial intelligence agent is an automated tool that carries out actions according to the user's instructions. The user expressly acknowledges and accepts that:
- The AI is non-deterministic: the same instruction may produce different results in each execution.
- The AI may make mistakes, interpret instructions incorrectly, produce unexpected results or invent information that appears real but is false (a phenomenon known as "hallucination").
- The AI may carry out irreversible actions: deleting files, sending messages, modifying configurations or running commands that cannot be undone.
- The agent's responses DO NOT constitute professional advice of any kind (legal, medical, financial, tax, technical or of any other nature). The user must verify any information provided by the agent before acting upon it.
- The user is responsible for supervising the agent's actions and for reviewing the results before considering them final.
- The agent may have access to external services connected by the user (email, servers, APIs). The actions performed on those services are the user's responsibility.
7. Hibernation of inactive agents
WEB3 reserves the right to hibernate (temporarily suspend) any agents that remain inactive for a prolonged period, in order to optimize the Service's resources.
Hibernation does not entail any loss of data or configuration. The user may reactivate their agent at any time and at no additional cost by contacting us through the hablo.es support chat (@equipo360_bot on Telegram) or by writing to support@hablo.es.
8. User responsibilities
The user is solely responsible for:
- Providing clear and precise instructions to the agent.
- Reviewing the changes and actions performed by the agent.
- Keeping backups of their important data.
- Managing the access credentials for external services and revoking them when they are no longer needed.
- Not sharing third parties' personal data without their consent through the agent.
- Ensuring that their use of the Service complies with the legislation applicable to their activity.
- Complying with the legal obligations applicable to their agent's website (subdomain *.kas.es), including, where applicable, the identification of the owner in accordance with the LSSI (Spanish Information Society Services Act) and any legal notice, privacy policy or cookie policy that current regulations require based on the site's content and functionalities. hablo.es acts exclusively as an infrastructure provider and is not responsible for the regulatory compliance of the client's website.
9. Limitation of WEB3's liability
WEB3 shall not be liable for:
- Loss of data, content, configurations or any other element as a result of the AI agent's actions, including irreversible actions.
- Direct, indirect, incidental, special or consequential damages arising from the use of the Service, including but not limited to: loss of sales, business interruption, loss of profits or loss of data.
- Errors, omissions, hallucinations or incorrect results produced by the AI models.
- Decisions made by the user based on the information provided by the agent.
- Actions carried out by the agent on external services connected by the user (email, SSH servers, third-party APIs, etc.).
- Service interruptions caused by third parties (hosting providers, external APIs, Telegram, etc.).
- The content generated by the AI (texts, images, code, etc.), the review and use of which is the user's sole responsibility.
In any event, WEB3's maximum aggregate liability towards the user on any account shall not exceed the total amount paid by the user over the last 3 months.
10. Data in transit
The user acknowledges and accepts that conversations with the agent are processed by third-party artificial intelligence models (Anthropic, OpenAI and other providers). The messages sent to the agent pass through the infrastructure of Telegram and/or the user's web browser.
The user is solely responsible for the information they choose to share with the agent. We recommend not sharing sensitive or confidential information, or third parties' personal data, through the agent.
11. Acceptable use
The user undertakes not to use the Service to:
- Engage in illegal activities or activities that infringe the rights of third parties.
- Generate unlawful, defamatory, obscene or hate-inciting content.
- Attempt to access the systems or data of other users.
- Intentionally overload the Service's resources.
WEB3 reserves the right to suspend or cancel the Service without prior notice in the event of a breach of these terms and conditions.
12. Service availability
WEB3 will endeavor to keep the Service continuously available but does not guarantee 100% availability. Maintenance work that involves temporary interruptions may be carried out, while seeking to minimize its impact.
13. Modification of the terms
WEB3 may modify these terms and conditions at any time. Changes will be notified to the user by email at least 15 days in advance. Continued use of the Service after that period implies acceptance of the new terms and conditions.
14. Governing law and jurisdiction
These terms and conditions shall be governed by the laws of Cyprus. For any dispute that may arise, both parties submit to the competent courts of Cyprus, without prejudice to the right of the user-consumer to bring proceedings before the courts of their place of residence.
